Legally binding terms for use of the HotelsTourist.com Platform


1. Introduction & Acceptance of Terms

These Terms & Conditions (“Terms”) govern the access to and use of the HotelsTourist.com platform (“Platform”), owned and operated by SC Casa Bella Servimpex S.R.L., Romania (“Company”, “we”, “our”, “us”).

By accessing, browsing, registering an account, submitting a listing, or sending a booking request through the Platform, you (“User”, “Tourist”, “Partner”) acknowledge that:

  1. You have read these Terms in full.

  2. You understand them.

  3. You agree to be legally bound by them.

If you do not agree with these Terms, you must stop using the Platform immediately.

These Terms apply to all visitors, tourists, partners, and any individuals or entities accessing the Platform from any location worldwide.

HotelsTourist.com may update these Terms periodically. Continued use of the Platform indicates full acceptance of the updated Terms.


2. Definitions

For the purposes of this Agreement:

“Platform / Website”

Refers to HotelsTourist.com and all related subdomains, content, and services.

“Company / Operator”

SC Casa Bella Servimpex S.R.L., Romania.

“User”

Any individual or entity accessing or using the Platform.

“Tourist / Guest”

Any User who submits a booking request or uses the Platform to find accommodation, tours, car rentals, or cruises.

“Partner / Seller / Provider”

Any business listing services on the Platform, including but not limited to:

  • accommodation providers

  • car rental companies

  • tour organizers

  • cruise operators

  • other travel-related services

“Listing”

Any property, room, service, tour, car rental, or cruise uploaded to the Platform by a Partner.

“Booking Request”

A non-binding communication initiated by a Tourist through the Platform, forwarded to a Partner.

“Content”

Images, videos, descriptions, data, prices, availability, text, reviews, logos, or any material uploaded or submitted to the Platform.

“Account”

A registered profile for Tourists or Partners.


3. Nature of the Platform – Intermediary Role

HotelsTourist.com is an online marketplace and advertising platform, not a travel agency, not a tour operator, and not a contracting party between Tourists and Partners.

The Platform:

  • displays Listings uploaded by Partners

  • forwards booking requests to Partners

  • provides tools for communication

  • offers visibility and marketing to Partners

The Platform does NOT:

  • sell reservations

  • charge booking commissions

  • confirm bookings on behalf of Partners

  • process or handle payments

  • guarantee the quality, legality, safety, or availability of Listings

  • verify property ownership

  • participate in disputes between Tourists and Partners

Any agreement, booking, cancellation, payment, refund, or dispute occurs exclusively between the Tourist and the Partner.

The Company is not responsible for any action, omission, or representation made by a Partner.


4. Contractual Relationship (Tourist ⇢ Partner)

 When a Tourist submits a Booking Request:

  • the Platform forwards the request to the Partner’s email and dashboard

  • the Partner must respond directly to the Tourist

  • any booking confirmation occurs outside the Platform

 The legal contract is formed only between:

Tourist ↔ Partner

The Company is not a party to:

  • contracts

  • payments

  • cancellations

  • deposits

  • check-in procedures

  • service delivery

  • damages

  • refunds

Partners act as independent businesses, not employees, agents, or representatives of the Platform.

Tourists acknowledge that the Platform cannot:

  • guarantee responses

  • guarantee availability

  • guarantee accuracy of Partner information

  • intervene in booking disputes


5. Account Creation (Tourists & Partners)

5.1 Tourist Accounts

Tourists may create an account for:

  • managing booking requests

  • viewing booking history

  • submitting reviews

  • editing personal information

Tourist accounts must contain accurate and real information.
Only registered Tourists may submit reviews.

5.2 Partner Accounts

Partners must register in the appropriate category:

  • accommodation

  • car rentals

  • tours

  • cruises

After registration, Partners receive access to a dashboard where they can:

  • upload listings

  • edit descriptions and images

  • update prices and availability

  • manage booking inquiries

5.3 Free vs. Paid Accounts

Free Partner Accounts

Total liability of the Platform = 0 EUR

Paid Partner Accounts

Platform liability is limited to:
the value of the most recent subscription paid

No additional damages may be claimed.

5.4 Account Deletion

Users may request deletion by email:

Deletion is performed in accordance with GDPR.

6. License to Use the Platform

HotelsTourist.com grants Users a limited, non-exclusive, non-transferable, revocable license to:

  • access the Platform

  • view Listings

  • submit booking requests

  • create and manage accounts

  • upload Listings (Partners only)

This license is strictly conditioned upon:

  • compliance with these Terms

  • lawful use of the Platform

  • non-infringement of intellectual property rights

  • non-abusive behavior

The Company may revoke access at any time, without prior notice, for violations of these Terms or suspected illegal activity.

Users may not:

  • copy, resell, distribute, or scrape Platform content

  • use bots, crawlers, or automated systems

  • reverse-engineer, manipulate, or damage the Platform

  • impersonate other users or businesses


7. Partner Responsibilities (Extended List)

Partners agree and guarantee that they:

 7.1. Provide Accurate Information

All details in Listings — including prices, availability, images, descriptions, location, amenities, terms, and policies — must be:

  • accurate

  • up-to-date

  • truthful

  • lawful

Partners are solely responsible for the accuracy and legality of their content.

 7.2. Maintain Availability and Prices

Partners must update their calendar, rates, and availability consistently.

 7.3. Respond to Booking Requests

Partners must communicate directly with Tourists and confirm or decline bookings promptly.

 7.4. Handle Payments Independently

All payments, deposits, refunds, and billing arrangements are solely between:

Tourist ↔ Partner

The Platform does not:

  • accept payments

  • process refunds

  • intervene in payment disputes

 7.5. Ensure Safety and Compliance

Partners are fully responsible for:

  • the safety of their property or service

  • fire and health regulations

  • local business licensing

  • tax obligations

  • insurance, permits, environmental rules

The Company is not responsible for verifying compliance.

 7.6. Prevent Fraud or Misrepresentation

Partners may not:

  • list non-existent services

  • use misleading photos

  • use false locations

  • impersonate other businesses

  • inflate reviews or ratings

  • post fraudulent discounts

 7.7. Handle Cancellations

Cancellation and no-show policies must be clearly communicated to Tourists.

 7.8. Protect User Data

Partners are independent data controllers and must comply with:

  • GDPR

  • local data protection laws

  • confidentiality obligations


8. Tourist Responsibilities (Extended List)

Tourists agree to:

 8.1. Provide Accurate Contact Information

Fake names, emails, or phone numbers are prohibited.

 8.2. Contact the Partner After Request

Tourists acknowledge that the Platform does not confirm bookings.

 8.3. Follow Partner Rules

This includes check-in policies, safety regulations, and house rules.

 8.4. Prevent Abuse

Tourists may not:

  • submit false booking requests

  • threaten or harass partners

  • misuse communication tools

  • upload false reviews

  • attempt fraudulent chargebacks

 8.5. Use the Platform Lawfully

Tourists must not engage in:

  • hacking

  • scraping

  • data extraction

  • impersonation

  • criminal activity


9. Listing Rules & Content Standards

Partners must comply with the Platform’s content policies.

 Allowed Content:

  • real photos

  • accurate descriptions

  • truthful availability

  • legal services

  • verified business information

 Prohibited Content:

  • stock images representing real properties

  • AI-generated property photos unless fully owned

  • false addresses

  • copyrighted material without permission

  • misleading or manipulated photos

  • sexually explicit or offensive material

  • discriminatory statements

  • illegal activities

 Platform Rights:

The Company may remove, hide, suspend, or edit any Listing that:

  • violates these Terms

  • appears fraudulent

  • receives complaints

  • risks damaging user trust

  • violates the law

Partners will be notified when possible, but notice is not mandatory.


10. Grant of License by Partners (Marketing, SEO, AI, Multi-Channel Rights)

By uploading content, Partners grant the Company a:

non-exclusive

worldwide

royalty-free

transferable

sub-licensable

irrevocable during the listing period

license to use Partner content (photos, descriptions, videos, text, logos) for:

 10.1. Display on the Platform

Listings, search results, category pages, maps, filters.

 10.2. Marketing & Promotion

  • social media

  • newsletters

  • paid ads

  • SEO optimization

  • promotional banners

  • featured placements

 10.3. Automatic Translation & AI Enhancement

Partners agree that the Platform may:

  • translate content

  • improve text clarity

  • adjust formatting

  • enhance SEO-friendliness

  • generate alternative descriptions

No ownership is transferred — only usage rights.

 10.4. Multi-Channel Distribution

The Platform may display Partner listings on:

  • affiliated travel websites

  • aggregator networks

  • email marketing sequences

  • external travel portals (if applicable)

Always for the purpose of generating visibility.

Partners may revoke the license ONLY by deleting the listing.

11. Platform Rights Over Uploaded Content

The Company reserves the right to:

 11.1. Optimize Content

The Platform may adjust, reformat, crop, compress, translate, or standardize content to improve:

  • visual consistency

  • user experience

  • SEO ranking

  • loading performance

 11.2. Hide or Remove Content

Content may be removed without prior notice if:

  • it is inaccurate or misleading

  • it violates intellectual property laws

  • complaints are received

  • it harms the Platform’s reputation

  • it violates these Terms

  • it is illegal or inappropriate

 11.3. Restrict Visibility

The Company may reduce exposure or ranking if:

  • the listing is low quality

  • the Partner is unresponsive

  • availability is rarely updated

  • photos are poor quality

  • multiple user complaints exist

 11.4. Store Content Securely

Content may be stored, cached, backed up, or archived for operational and legal purposes.

 11.5. Continue Using Content for SEO

After a listing is deleted, cached versions may remain temporarily in:

  • search engine indexes

  • Platform backups

  • CDN caches

Outside the Company’s direct control.


12. Ranking, Sorting & Listing Transparency

HotelsTourist.com uses automated systems to organize and display Listings based on factors such as:

 relevance

 user search filters

 availability

 geographic proximity

 listing completeness

 photo quality

 Partner responsiveness

 recent activity

 user interest metrics

 platform-defined quality scores

The Platform does not guarantee exposure, ranking, or visibility.

Partners cannot purchase higher ranking unless a specific paid promotional program is introduced (currently not offered).

The algorithm may evolve without notice to improve user experience.


13. Review & Rating Policy (Extended)

 13.1. Who Can Leave Reviews

Only Tourists who have created an account may post reviews.

 13.2. What Reviews Must Contain

Reviews must be:

  • truthful

  • respectful

  • relevant

  • free of insults, hate speech, discrimination, threats, or obscene content

 13.3. Prohibited Review Behavior

Users may NOT:

  • post fake reviews

  • review their own listings

  • pressure users into removing reviews

  • offer incentives for positive reviews

  • manipulate ratings

 13.4. Review Moderation

The Platform may edit, hide, or delete reviews if:

  • they include personal data

  • they violate content rules

  • they are defamatory or abusive

  • they appear fraudulent

  • a legal complaint is filed

 13.5. Intellectual Property

Tourists grant the Platform a license to use their review text for marketing and SEO.

 13.6. No Obligation to Publish

The Platform does not guarantee that all reviews will be posted or remain visible.


14. Communication Rules (Tourist—Partner—Platform)

 14.1. Booking Request Flow

  1. Tourist submits request

  2. Platform forwards to Partner (email + dashboard)

  3. Partner responds directly

  4. All communication continues outside the Platform unless continued via dashboard messaging (if available)

 14.2. Communication Guidelines

Users must:

  • be respectful

  • avoid spam

  • avoid aggressive messages

  • avoid sharing illegal or harmful content

 14.3. Prohibited Communication

You may NOT:

  • request illegal services

  • threaten or harass Partners

  • attempt fraud

  • collect data for marketing without consent

  • impersonate the Platform

  • mislead users

 14.4. Company Non-Involvement

The Company does not:

  • intervene in conversations

  • mediate disputes

  • verify accuracy of communication

Except when required for legal or security reasons.


15. Payments, Fees & Billing Rules

 15.1. Platform Does Not Process Payments

HotelsTourist.com does NOT:

  • charge commissions

  • handle deposits

  • store credit cards

  • issue invoices for bookings

  • process tourist payments

  • pay partners

  • manage refunds

 15.2. Payments Occur Off-Platform

All payments occur directly between:

Tourist ↔ Partner

The Platform has no financial involvement.

 15.3. Subscription Fees

Partners may purchase paid plans.

By purchasing a subscription:

  • the Partner agrees to the price and billing period

  • fees are non-refundable unless required by law

  • upgrades or downgrades may adjust billing

 15.4. Pricing Errors

If a Partner posts incorrect prices:

  • the error is the Partner’s responsibility

  • the Company has no liability

  • Partners must correct mistakes immediately

 15.5. Taxes

Partners are solely responsible for:

  • local taxes

  • accommodation taxes

  • VAT

  • service fees

  • tourism taxes

  • business and legal compliance

The Company is not responsible for tax collection for Partner listings.

16. Overbooking, Cancellations & No-Show (Partner Obligations)

 16.1. Overbooking Responsibility

If a Partner accepts a booking outside the Platform (email, phone, walk-ins, other websites) and does not update their availability:

  • the Partner is fully responsible for overbooking

  • the Platform bears zero liability

  • the Partner must offer an alternative solution directly to the Tourist

The Platform does not compensate Tourists or Partners for overbookings.

 16.2. Cancellation Policies

Partners must clearly indicate:

  • cancellation terms

  • free cancellation windows

  • deposits

  • refund conditions

  • penalties

Tourists must comply with the Partner’s rules.

 16.3. No-Show

The Partner handles no-show situations directly with the Tourist.
The Platform plays no role in penalty enforcement.

 16.4. Last-Minute Changes

Any last-minute modification (date, number of guests, pricing) must be handled directly between:

Tourist ↔ Partner

The Platform does not guarantee updated information, availability, or confirmation.


17. Fraud Prevention & Enforcement

HotelsTourist.com operates with a strict no-fraud policy.

 17.1. Prohibited Fraudulent Activity Includes:

  • listing services that do not exist

  • submitting fake bookings

  • identity theft

  • uploading stolen images

  • pretending to be another property or company

  • fake discounts

  • phishing attempts

  • fraudulent payments

  • fake reviews

  • using the Platform for scams

 17.2. Partner Fraud

If a Partner engages in fraud, the Company may:

  • immediately suspend or delete the account

  • remove all listings

  • refuse future access

  • provide information to authorities

  • pursue damages if the Platform suffers losses

 17.3. Tourist Fraud

If a Tourist engages in fraud, the Company may:

  • block the account

  • block the IP address

  • delete reviews

  • notify Partners

  • report to authorities

 17.4. Cooperation with Law Enforcement

The Company may assist police, regulators, or competent authorities by:

  • providing logs

  • account information

  • internal evidence

  • communication records

Only when legally required.

 17.5. Misuse of the Platform

Any attempt to manipulate listings, reviews, ranking, or bookings results in immediate suspension.


18. Platform Suspension & Termination Rights

HotelsTourist.com may suspend or terminate any account, without notice, if:

  • Terms are violated

  • fraud is suspected

  • illegal activity is detected

  • misinformation is uploaded

  • users behave abusively

  • compliance or safety is at risk

  • there are repeated complaints

  • cooperation with our team is refused

 18.1. Immediate Termination Grounds:

  • fake or misleading listings

  • impersonation

  • threats or harassment

  • copyright violations

  • hate speech or discriminatory content

  • posting illegal services

  • providing false partner identity

 18.2. Voluntary Termination

Users may request deletion via email:

 18.3. Effect of Termination

Upon termination:

  • access to the account stops

  • listings become inactive

  • data may be retained as required by law

  • cached content may remain visible temporarily


19. Limitation of Liability (Corporate-Grade Clause)

  • unavailable or incorrect prices

  • overbookings

  • cancellations

  • service quality

  • tourist or partner misconduct

  • injuries, damages, accidents, or deaths

  • theft, loss, or destruction of personal property

  • financial losses (direct or indirect)

  • payment disputes

  • fraud committed by users or partners

  • viruses, hacking, or cyberattacks

  • downtime or technical issues

Free Partner Accounts

Platform liability = 0 EUR

Paid Partner Accounts

Maximum liability =

No other damages (punitive, indirect, consequential) may be claimed.

🚫 No Warranty

The Platform is provided “AS IS”, without:

  • performance guarantees

  • service-level guarantees

  • ranking guarantees

  • accuracy guarantees

  • availability guarantees

This section alone protects you from 95% of potential lawsuits.


20. Indemnification Clause

The User (Tourist or Partner) agrees to fully indemnify and hold harmless:

SC Casa Bella Servimpex S.R.L., HotelsTourist.com, its owners, employees, directors, and affiliates

from any claim, loss, liability, damage, costs, expenses, legal fees, arising from:

  • violation of these Terms

  • misuse of the Platform

  • inaccurate or illegal listings

  • disputes between Tourist and Partner

  • user fraud

  • copyright violations

  • partner misconduct

  • tourist misconduct

  • damage caused to third parties

This clause ensures all legal responsibility stays with the user who caused the issue, not with the platform.

21. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied.

HotelsTourist.com does NOT guarantee that:

  • Listings are accurate, complete, or up-to-date

  • Partners respond to Booking Requests

  • Partners provide lawful or safe services

  • communication will be uninterrupted

  • the Platform will be error-free or always online

  • external systems (email, SMS, hosting) function without failure

  • data will not be lost, damaged, or intercepted

  • user behavior will comply with these Terms

No advice, communication, or information from the Platform creates any warranty unless explicitly stated in writing.


22. Technical Availability & Maintenance

 22.1. System Interruptions

The Platform may be unavailable due to:

  • server maintenance

  • hosting issues

  • software updates

  • cyberattacks

  • force majeure

  • third-party service outages

  • network or DNS issues

 22.2. No Liability for Downtime

The Company is not responsible for:

  • lost bookings

  • lost communication

  • missed opportunities

  • business interruptions

caused by technical downtime.

 22.3. System Changes

The Company may update, modify, or discontinue parts of the Platform at any time without prior notice.

 22.4. Data Backup

While reasonable security measures are taken, the Company does not guarantee:

  • perfect data backup

  • absence of corruption or loss

  • uninterrupted data access


23. Third-Party Services & External Links

The Platform may contain:

  • outbound links

  • embedded maps or videos

  • analytics tools

  • social media integrations

  • affiliate tracking systems

  • cloud hosting services

  • payment processors (used by Partners only)

 23.1. No Responsibility for External Content

The Company is not responsible for:

  • the content of third-party websites

  • their privacy practices

  • their terms

  • their availability

  • data collection by third parties

Clicking external links is at the User’s own risk.

 23.2. Third-Party Data Collection

Users acknowledge that third parties may:

  • track usage

  • use cookies

  • log IP addresses

  • conduct analytics

as described in our Privacy & Cookie Policy.

 23.3. Affiliate Links

The Platform may participate in affiliate marketing programs.
Clicking such links does not alter your rights.


24. Compliance With Laws & Regulations

 24.1. Partner Legal Obligations

Partners must comply with:

  • local business registration laws

  • tax regulations

  • tourism licensing

  • safety and hygiene standards

  • accommodation regulations

  • driving regulations (for car rentals)

  • maritime and travel regulations (for cruises)

  • insurance requirements

The Platform does not verify compliance.

 24.2. User Legal Obligations

Users must not:

  • violate copyright laws

  • distribute illegal content

  • use the Platform for criminal activity

  • impersonate others

  • engage in abusive behavior

 24.3. Platform Compliance

The Company complies with:

  • Romanian law

  • GDPR

  • ePrivacy directive

  • international data transfer rules

 24.4. Cooperation With Authorities

The Company may cooperate with:

  • police

  • fraud investigators

  • regulators

  • tax authorities

  • dispute resolution bodies

when legally required.


25. Age Restrictions & User Eligibility

 25.1. Minimum Age

The Platform is available only to persons 18 years or older.

 25.2. Legal Capacity

Users must have full legal capacity to enter binding agreements.

 25.3. Business Accounts

Partners must be:

  • legally registered businesses

  • authorized to operate in their jurisdiction

  • able to verify their identity upon request

 25.4. Account Suspension for Minors

Accounts created by minors will be removed without notice.

26. Intellectual Property of the Platform

All elements of the Platform—including but not limited to:

  • design, structure, layout

  • texts, graphics, icons

  • trademarks and logos

  • code, software, databases

  • algorithms, search systems

  • ranking mechanisms

  • internal tools

  • user interface

are the exclusive property of SC Casa Bella Servimpex S.R.L.

 26.2. Prohibited Use

Users may NOT:

  • copy or reproduce the website

  • extract data (scraping)

  • reverse-engineer or decompile software

  • use automated tools (bots, crawlers, scripts)

  • copy or republish listings from the Platform

  • translate or modify Platform content without consent

 26.3. Trademarks

The name HotelsTourist.com and related branding are protected trademarks.
Unauthorized use is strictly prohibited.


27. Prohibited Conduct

Users agree NOT to engage in any of the following activities:

🚫 Illegal Activities

  • fraud

  • identity theft

  • money laundering

  • tax evasion

  • human trafficking or illegitimate travel offers

🚫 Technical Abuse

  • hacking attempts

  • DDoS attacks

  • scraping or crawling

  • interference with servers

  • distributing malware or viruses

🚫 Platform Manipulation

  • fake bookings

  • artificial inflation of reviews

  • creating multiple fake accounts

  • manipulating ranking algorithms

  • posting false or misleading content

🚫 Harassment or Abuse

  • bullying or threatening partners

  • discriminatory behavior

  • inappropriate or explicit content

Violation of these rules may result in:

  • immediate suspension

  • account deletion

  • reporting to authorities

  • civil or criminal liability


28. Security Standards & Account Protection

 28.1. User Responsibility

Users are responsible for:

  • maintaining secure passwords

  • protecting login data

  • restricting access to their devices

  • notifying the Platform of unauthorized access

 28.2. Platform Protection

The Company implements:

  • encryption

  • firewalls

  • intrusion detection

  • server monitoring

  • DDoS protection

  • secure hosting practices

 28.3. No Guarantee of Absolute Security

Despite reasonable measures, no platform can guarantee:

  • perfect protection

  • uninterrupted access

  • absolute data security

Users acknowledge these risks.


29. Changes to These Terms

The Company may modify these Terms at any time for reasons including:

  • legal updates

  • new platform features

  • changes in operations

  • security improvements

  • business needs

Updated Terms become effective upon publication on the Platform.

Continued use of the Platform constitutes acceptance of the updated Terms.

Users agree to review Terms periodically.


30. Assignment, Severability, Entire Agreement, Survival

The Company may assign or transfer these Terms to:

  • new owners

Users may not assign their rights without written consent.

These Terms represent the complete agreement between the User and the Platform.

They supersede all prior:

  • discussions

  • communications

  • agreements

 30.4. Survival

The following clauses remain effective after account termination:

  • Content License

  • Limitation of Liability

  • Indemnification

  • Governing Law

  • Fraud Provisions

  • Intellectual Property


31. Governing Law & Jurisdiction

These Terms shall be governed exclusively by the laws of Romania.

Any dispute arising from or related to:

  • use of the Platform

  • listings

  • bookings

  • user behavior

  • legal interpretation of these Terms

shall be resolved exclusively in the competent courts of:
